Democracy is dying, and we are running out of time to save it. The theft of power and influence from ordinary citizens, and its transfer to unelected, unaccountable lawyers and technocrats is accelerating. The populist backlash, when it comes, will be devastating, but in the meantime the Left-wing elites are doubling down, using every possible justification to expand their empires. In an incendiary judicial coup this week, the European Court of Human Rights (ECHR) greatly expanded its own remit while downgrading democracy another notch. In a ruling that would almost be funny if it weren’t so serious, its Grand Chamber ruled that countries that don’t reduce carbon emissions fast enough are violating their citizens’ right to private and family life. This risible decision is bad news for anybody who questions the rush to compulsory electric cars, or heat pumps, or smart meters, or higher taxes on carbon: your views are no longer welcome, and will no longer matter. The judgment was meted out against Switzerland, but will set a precedent to all signatories of the European Convention on Human Rights, including Britain. The heroic Swiss had voted down a set of net zero measures in a referendum: the ECHR has effectively blown up Europe’s most democratic constitution, in a stark warning to the growing band of net zero dissenters in Britain, France, the Netherlands and Germany. This isn’t only about the courts telling the politicians to implement their own laws and their own “carbon budgets”, as in a conventional judicial review: this ruling goes much further, stating that the only way a state can stay on the right side of human rights law is by rushing to decarbonise. The problem is obvious: if a rise in temperature violates our right to a private and family life, what doesn’t? Where will the ECHR power grab end? The game here is clear. By making everything about “human rights” that cannot be questioned, then the democratic sphere, where we can debate and disagree and vote for different approaches, is drastically curtailed, and the influence of Left-wing lawyers massively increased.

La democracia está muriendo y se nos acaba el tiempo para salvarla. Se está acelerando el robo de poder e influencia de los ciudadanos comunes y corrientes y su transferencia a abogados y tecnócratas no electos y que no rinden cuentas. La reacción populista, cuando llegue, será devastadora, pero mientras tanto las élites de izquierda están redoblando sus esfuerzos, utilizando todas las justificaciones posibles para expandir sus imperios. En un incendiario golpe judicial esta semana, el Tribunal Europeo de Derechos Humanos (TEDH) amplió enormemente su propio mandato y al mismo tiempo degradó la democracia un nivel más. En un fallo que casi sería divertido si no fuera tan grave, su Gran Sala dictaminó que los países que no reducen las emisiones de carbono con la suficiente rapidez están violando el derecho de sus ciudadanos a la vida privada y familiar. Esta ridícula decisión es una mala noticia para cualquiera que cuestione la carrera hacia los coches eléctricos obligatorios, las bombas de calor, los contadores inteligentes o los impuestos más altos sobre el carbono: sus opiniones ya no son bienvenidas y ya no importarán. La sentencia se dictó contra Suiza, pero sentará un precedente para todos los signatarios del Convenio Europeo de Derechos Humanos, incluido Gran Bretaña. Los heroicos suizos habían rechazado un conjunto de medidas de cero emisiones netas en un referéndum: el TEDH ha hecho saltar por los aires la constitución más democrática de Europa, en una dura advertencia al creciente grupo de disidentes de cero emisiones netas en Gran Bretaña, Francia, los Países Bajos y Alemania.No se trata sólo de que los tribunales digan a los políticos que implementen sus propias leyes y sus propios “presupuestos de carbono”, como en una revisión judicial convencional: este fallo va mucho más allá, afirmando que la única forma en que un estado puede permanecer en el lado correcto de las normas de derechos humanos es apresurarse a descarbonizar. El problema es obvio: si un aumento de temperatura viola nuestro derecho a la vida privada y familiar, ¿qué no lo hace? ¿Dónde terminará la toma de poder del TEDH? El juego aquí es claro. Al hacer que todo lo relacionado con los “derechos humanos” no pueda ser cuestionado, la esfera democrática, donde podemos debatir, estar en desacuerdo y votar por diferentes enfoques, se restringe drásticamente y la influencia de los abogados de izquierda aumenta enormemente.
